THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.25022 OF 2004 ORDER:

When the matter is taken up for hearing, it is noticed that the writ petition against respondent Nos.2 and 3 was dismissed for default, by order, dated 30.12.2010, and the petitioner has not taken any steps to ensure that the writ petition against respondent Nos.2 and 3 is restored. The petitioner filed the writ petition challenging the award, dated 20.02.2004, passed in I.D. No.41 of 2000, by the Labour Court-III - respondent No.1 herein wherein no relief was granted to the petitioner. When the petitioner filed the present writ petition challenging the award passed by respondent No.1 and also seeking reinstatement relief against respondent Nos.2 and 3, in the absence of respondent Nos.2 and 3, the writ petition cannot be adjudicated on merits.

With the above observation, the present Writ Petition is dismissed. However, in the circumstances of the case, there shall be no order as to costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the present writ petition stand closed.
