THE HON'BLE SRI JUSTI CE C. PRAVEEN KUMAR WRI T PETI TI ON No.41509 OF 2016 ORDER:

Heard the learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents. With their consent, the Writ Petition is disposed of at the admission stage itself.

2.

The present Writ Petition came to be filed with the following prayer:

"...to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondent No.1 issued in memo No.31617/Regn.II/A1/2012-4, dated 31-08-2015 as illegal, arbitrary and violation of Article 19(1)(g) of the Constitution of India and Contrary to the Provision of Notaries Act and Rules, consequently, direct the Respondent No.2 to renew the application of the petitioner certificate of practice without reference to Memo No.31617/Regn.II/A1/2012-4, dated 31-08-2015."

3.

It is represented by the learned counsel for the petitioner that the issue involved in the writ petition is squarely covered by an Order of this Court, dated 02.12.2016, rendered in W.P.No.9655 of 2016 and Batch.

4.

Learned Government Pleader for Revenue opposed the same contending that the application for renewal came to be filed after expiry of the licence period, therefore, the request of the petitioner cannot be considered. Learned counsel for the petitioner did not

CPK,J WP_41509_2016 dispute the same with regard to filing of application after expiry of licence period.
