THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE No.2572 of 2016 ORDER:

This Criminal Revision Case is filed under Sections 397 and 401 Cr.P.C. questioning the orders dated 26.09.2016 in Crl.M.P.No.647 of 2016 in C.C.No.5 of 2016 on the file of the Court of the Judicial Magistrate of First Class, Palamaner & FAC/ Special Magistrate, Palamaner.

When the matter is taken up for hearing, learned counsel for the petitioner Sri V.Surendra Reddy, seeks permission of this court to permit the petitioner to withdraw the Criminal Revision Case with a liberty to appear before the trial Court. He further submitted that the trial Court may be directed to dispose of the petition if any filed by the petitioner under Section 70(2) Cr.P.C. on the same day. Permission is granted.

Accordingly, this Criminal Revision Case is dismissed as withdrawn. The trial Court is hereby directed to dispose of the petition, if any filed by the petitioner under Section 70(2) Cr.P.C. on the same day taking into consideration the health condition of the petitioner and other attending circumstances without being influenced with the orders passed in Crl.M.P.No.647 of 2016. As a sequel, the miscellaneous petitions, pending if any, shall stand closed.
