HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 17979 of 2016 ORDER:

Heard learned counsel for the petitioner and Government Pleader for Home. There is no necessity to put the unofficial respondent on notice as this Court is not venturing to adjudicate the issue on merits.

The grievance of the petitioner is that the respondent authorities are summoning the petitioner, her mother and ailing sister frequently to the police station and sit them in the police for hours together at the behest of respondent No.4, without there being any complaint or case registered against them. The averments in the affidavit filed in support of the writ petition would show that at the behest of respondent No.4, the police authorities are harassing the petitioner, her mother and ailing sister by summoning them to the police station alleging that the daughter of respondent No.4 eloped with the sister's son of the petitioner. It is also stated that though they are no way concerned with the said incident, respondent No.3 forcibly obtained an undertaking from them to produce the daughter of respondent No.4 before the respondent No.

It is further stated that the enquiries made by the petitioner reveals that the father of the girl, who eloped with the sister of the petitioner, died about six years ago and respondent No.4 who is the mother of the girl is residing with one Mr.Ramana and they used to harass the girl mentally, physically and sexually by forcing her to marry a person of their choice.

Having regard to the facts and circumstances of the case, the respondent-police are directed not to summon the petitioner, her mother and sister to the police station, except following due process of law.

With the above direction, the writ petition is disposed of. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
