HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No. 9746 of 2013 ORDER:

This writ petition is filed to declare the action of the respondents in not releasing the widow pension to the petitioner on the death of her husband who was drawing pension under PPO No.50339 under Employees Pension Scheme, 1995 even after lapse of nearly one year as illegal and arbitrary.

This Court passed interim order on 02-04-2013 as under: "The discrepancies pointed out by the Employees Provident Fund Organization in the communication dated 19-04-2012 are superficial and do not withstand scrutiny.

The name of the petitioner's husband is stated to be the same but the name of the father of the petitioner's husband as per the records is Laxmaiah whereas the death certificate mentions it as Laxma Reddy. Once the name of the petitioner's husband is shown as K.Narasimha Reddy, the objection as to the petitioner's husband's father's name appears to be farcical.

Similarly, the other objection taken is to the name of the petitioner. Her name is spelt as "Sattemma" in the records of the organization while the account particulars show it as 'Sathamma'. This is hardly a ground worthy of mention.

The third objection raised is with regard to the mentioning of the word 'no' in a particular column by the petitioner. Ignorance on the part of the petitioner in filling up the form can hardly be a ground to reject or belittle her entitlement to receive pension. There shall accordingly be a direction to the respondents to reconsider within three weeks from the date of receipt copy of this order the petitioner's application for widow pension in respect of PPO No.50339 in accordance with the rules without harping on technicalities."

Learned Standing Counsel for the respondents states the petitioner's application is reconsidered and the petitioner was granted pension and also paid to her.

In view of the same, the grievance of the petitioner stood redressed and as such, the writ petition is disposed of in terms of interim order. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
