THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.30049 of 2017 O R D E R:
With the consent of the parties, this writ petition is disposed of at the stage of admission.
The petitioners and respondent Nos.6 to 12 claim right over the land admeasuring Acs.6.04 guntas in Survey No.242 of Medipally Village, Yacharam Mandal, Ranga Reddy District, which was acquired for Hyderabad Green Pharma City, Yacharam, Hyderabad.
Learned counsel for the petitioner submits that as on date, no Award has been passed on account of the rival claims between the petitioners and respondent Nos.6 to 12. Inasmuch as no Award is passed as on date, the petitioners and respondent Nos.6 to 12 are at liberty to file their claims before respondent No.2-District Collector, Ranga Reddy District, who is duty bound to consider the same based on the material that may be placed before him and decide who are the persons entitled to receive the compensation for the land under acquisition. As and when Award is passed, if either of the parties is aggrieved by the same, they have a further remedy in terms of Section 64 of the Right to Fair Compensation and Transparency
in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short 'the Act').
In those circumstances, the writ petition is disposed of, giving liberty to the petitioners and respondent Nos.6 to 12 to file their claims as per the provisions of the Act before respondent No.2, who, in turn shall consider and adjudicate the same. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:26.04.2018 kdl
