THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.20444 of 2005 ORDER:

The writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus directing the respondents 1 and 2 to consider the petitioner's case for promotions as Assistant Accounts Officer with effect from 08.09.2005, the date on which the third respondent has been promoted with all consequential benefits by setting aside the proceedings No.CESS.Estt.No.I.D.No.1426/2005 dated 08.09.2005 of the first respondent, by which the third respondent has been given promotion as Assistant Accounts Officer by holding the same to be arbitrary, violative of Article 14 of the Constitution of India and illegal.

At the time of hearing, learned counsel for the petitioner submitted that no further orders are necessary in this writ petition in view of the disposal of departmental appeal filed by the petitioner on 28.04.2006.

In view of the submission made by the learned counsel for the petitioner, the writ petition is closed. However, closing of this writ petition does not preclude the petitioner to avail the remedies available to him under law against the dismissal order dated 28.04.2006. Consequently, the miscellaneous petitions if any pending in this writ petition shall stand closed.
