THE HON'BLE SMT JUSTICE T. RAJANI CRIMINAL PETITION No.2627 of 2018 ORDER:

This petition is filed under Section 438 Cr.P.C. seeking to grant anticipatory bail to the petitioner, who is A3 in Crime No.19 of 2017 on the file of Pedabayalu Police Station, Visakhapatnam District.

Heard learned counsel for the petitioner and the learned Public Prosecutor appearing for the respondentState. 3.

As per the case of the prosecution, it is A3 who purchased Ganja at request of A1. The quantity seized is 200 Kgs of Ganja. The rigours of Section 37 of the NDPS Act would operate against the petitioner, in obtaining bail. Therefore, the petitioner is not entitled for grant of bail. 4.

Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any pending, in this petition shall stand closed.
