This petition is filed, under Section 438 of the Code of Criminal Procedure, 1973, seeking for grant of anticipatory bail to the petitioner in an unregistered crime on the file of Prohibition and Excise Station, Duggirala, Guntur District. 2.

Heard learned counsel for the petitioner and learned Public Prosecutor (A.P.).

The petitioner is not arrayed as accused but his apprehension is that his name has come up during the confession of accused No. 2. Even if the apprehension of the petitioner is considered as well founded, the facts of the case do not entitle him for granting anticipatory bail, as the allegation is that he was also purchasing nipes from accused No. 2 for selling cheap liquor. Hence, considering the above, this Court opines that it is not a fit case for granting anticipatory bail to the petitioner.

The criminal petition is accordingly dismissed. Pending miscellaneous petitions if any shall stand dismissed in consequence.
