This contempt case is filed alleging violation of the order dated 28-12-2016 passed in WP No.45969 of 2016, wherein this Court directed the respondent authorities to consider the case of the petitioner, as per merit and Rules in force, as to his appointment as Sharmic.
Now, learned Standing Counsel for the respondentCorporation submits that in compliance of the order of this Court, the case of the petitioner has been examined, but as the petitioner could secure only 84.90 marks and ranked at no.9 in overall merit list among SC candidates, his case could not considered and accordingly rejected. On the other hand, learned counsel for the petitioner tried to contend that the order now passed is not in terms of the Regulations governing the field.
In this contempt case, the correctness or otherwise of the order rejecting the case of the petitioner cannot be gone into. If so advised, it is open for the petitioner to challenge the said rejection order, if it is not in tune with the Regulations in force, as alleged by him. Inasmuch as, in terms of the order of this Court, the case of the
petitioner has been considered and rejected, no further orders need be passed in this contempt case. The contempt case is accordingly closed. Miscellaneous petitions, if any pending shall also stand closed. No order as to costs.
