When the matter is taken up for hearing, it is submitted by Sri G. Venkateswarlu, learned Standing Counsel for respondent No.1 - Employees State Insurance Corporation, that the writ petition as against respondent No.3 was dismissed for default vide order dated 30.12.2010 passed by this Court and thereafter the petitioner has not taken any steps to ensure that the writ petition is restored against respondent No.3. As the petitioner is seeking a direction against respondent No.3, in the absence of respondent No.3, this writ petition cannot be adjudicated on merits.

The writ petition is accordingly dismissed. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
