THE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY Contempt Case No.310 of 2017 ORDER:

This Contempt Case is filed alleging violation of orders dated 14.12.2012 passed by this Court in W.P.M.P.No.48891 of 2012 in W.P.No.38544 of 2012.

By the above said order, this Court has directed respondent Nos.3 and 4 neither to dispossess the petitioners nor to lay the road through their land bearing Sy.No.239/A Tarfa Douthial situated at Saraswathinagar, Bodhan, Nizamabad District , without following due procedure under law more particularly under the provisions of A.P.Municipalities Act 1965.

On 07.04.2017 this court ordered notice and so far contempt case has not been admitted taking cognizance under the provisions of the Contempt of Courts Act.

Learned counsel for the petitioner has contended that the respondents laid the road from the petitioner's land, thereby violated the orders of this Court.

Counter affidavit has been filed by respondent and in para 10 of the counter affidavit it is stated that the respondent has not taken any steps for laying the road from the alleged land of the petitioner and he has not violated the order passed in W.P.M.P.No.48891 of 2012 dated 14.12.2012.

Accordingly, this Contempt Case is closed. However, liberty is given to the petitioners, if any cause survives, to file fresh application seeking revival of the contempt case in accordance with law after disposal of the main writ petition.

Miscellaneous petitions, if any pending in this contempt case shall stand closed.
