THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No. 33230 of 2016 ORDER:

The petitioner states that he is working as School Assistant in ZPHS, Vankamamidi, Pochampally Mandal, Nalgonda District. While working as such, he was kept under suspension by the fourth respondent pending enquiry, which ultimately culminated in imposing a punishment of withholding two annual increments with cumulative effect and recovery of an amount of Rs.45,490/- by proceedings dated 03.08.2010. A criminal case in C.C.No.57 of 2011 was also registered and the petitioner was acquitted in the said case on 21.07.2014. After acquittal in the criminal case, the petitioner submitted a representation on 28.10.2014 to the fourth respondent requesting him to reconsider the punishment imposed and for regulating the period of suspension. When the said representation is not disposed of, the present Writ Petition is filed. 2.

Since the representation of the petitioner is pending before the fourth respondent, this Court is not inclined to go into the merits, but directs the fourth respondent to consider the representation of the petitioner dated 28.10.2014 and pass appropriate orders thereon in accordance with law within a period of three (3) months from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
