THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2854 OF 2015 ORDER:

The petitioner filed this Criminal Revision Case by invoking the provisions under Sections 397 and 401 of the Criminal Procedure Code being aggrieved by the order dated 27-10-2015 passed in Crl.M.P.No.268 of 2015 by the Additional Metropolitan Sessions Judge, Ranga Reddy District, Cyberabad.

Heard and perused the records.

Considering the facts and circumstances of the case, the Criminal Revision Case is disposed of with the following directions : The lower appellate Court is directed to restore the application filed by the petitioner to condone the delay and after issuance of notice to either side, pass appropriate orders in the Condone Delay Petition. In the meanwhile, since the petitioner is in prison, the lower appellate Court is directed to suspend the sentence of imprisonment and release the petitioner on bail on his executing a personal bond for a sum of Rs.10,000/- with one surety for the like sum to the satisfaction of the I Special Magistrate at Hasthinapuram, Ranga Reddy District. Miscellaneous petitions pending in this revision, if any, shall stand closed.
