Karimi Sai Malleswara Rao v. The State Of A.P.
THE HON'BLE SMT JUSTICE T. RAJANI CRIMINAL PETITION No.2635 of 2018 ORDER:
This petition is filed under Sections 437 and 439 Cr.P.C. seeking to grant regular bail to the petitioner, who is sole accused in Crime No.478 of 2017 on the file of S.N. Puram Police Station, Viijayawada District.
2.
Heard learned counsel for the petitioner and the learned Public Prosecutor appearing for the respondentState. 3.
The case of the prosecution is that 50 Kgs of Ganja in 5 packets, containing 10 kgs in each packet, is involved in this case. There are no grounds to grant bail to the petitioner unless two conditions laid down under the Section 37 of the Act are fulfilled. The counsel for the petitioner does not state any reason to overcome the said conditions. But, he relied on a certificate which is issued by a Doctor showing that father of the petitioner is suffering from Paralysis. But, the said certificate does not inspire confidence, as the person who has to render service is also mentioned in the said certificate. It appears that the Doctor has gone to such extent, only in order to help the petitioner. Therefore, it is not a fit case to grant bail to the petitioner.
4.
Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any pending, in this petition shall stand closed.
