THE HON'BLE SRI JUSTI CE A.V.SESHA SAI W.P.No.6947 OF 2018 ORDER:
When the matter is taken up for hearing, written instructions dated.01-03-2018 furnished by the Assistant Sub Inspector of Police, Madhapur, Cyberabad Commissionerate are placed on record by the learned Government Pleader for Home. The said instructions, to the extent of their relevance, read as under: - " On receipt of a complaint from the petitioner herein lodged with the Police of Madhapur PS, Cyberabad Commissionerate, a case in Cr.No.110/ 2018 U/ Secs.448, 428, IPC, dated 06-02-2018 was re4gistered against Mr.Maladri and Venu who are the unofficial respondents 3 and 4 herein as they trespassed into the Tiffin center and thrown out the articles in the Tiffin center belongs to the petitioner and kept bricks in that place and for the past six months the above named persons abusing her in filthy language and taken up the investigation into the case. During the course of investigation, the investigation officer examined the complainant/ petitioner and other witnesses and recorded their detailed statements.
As part of investigation into the case, Notice U/ Sec.41(A)(1) Cr.P.C. dated 7-2-18 was issued to the accused A1 and A2 who are the unofficial respondents 3 and 4 herein.
It is pertinent to submit that the FIR was registered on 6-2-18 Complainant/ petitioner and other witnesses were examined. Notice 41(A)(1) Cr.P.C was also issued to the A-1 and A2 herein on 7-2-18. The investigation is pending for want of collection of more evidence to establish the offences. To complete the full fledged investigation into the case, it requires some more time to the investigating agency. It is submitted that the allegation of the petitioner that the respondents 3 and 4 are threatening her with dire consequences and trying to kill her by coming frequently to her premises in the night hours with anti social elements, in this regard, I humbly submit that the petitioner did not approach this respondent about the said allegation. If petitioner approach this respondent with a complaint appropriate action will be taken in accordance with law."
On noticing the same, a request is made by the learned counsel for the petitioner to place the above instructions on record and dispose of the writ petition.
Accordingly, the writ petition is disposed of by placing on record the above written instructions. No costs. Miscellaneous Petitions pending, if any, shall stand closed.
