Heard learned counsel for petitioner and the standing counsel for second respondent.

At request of standing counsel on 29.11.2016, the writ petition is adjourned to today.

The standing counsel has placed before the Court the record relating to the order impugned in the writ petition. The standing counsel fairly submits that the communication impugned in the writ petition though styled as notice, communicates a decision taken not to accept stocks (Sanna Biyyam) supplied by petitioner. Therefore, he submits that the communication can be treated as a show cause notice and petitioner can be given one week time from today to file explanation to the charges leveled against petitioner. The second respondent it is stated will consider and pass final orders in the matter.

The statement is placed on record. The writ petition is ordered as follows:
a) The second respondent is directed to examine the allegations, the explanation offered by the petitioner, take a final decision and communicate to petitioner. b) The operative portion or the decision not to accept stocks supplied by petitioner in the communication
impugned in the writ petition, in the meantime, shall not be given effect to.
