THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 8495 of 2019 O R D E R:

Heard learned counsel for the petitioner and learned Government Pleader for Fisheries for respondents 1 to 3. 2.

This writ petition is filed seeking to direct the respondents to conduct departmental fishing by permitting the members of the Fishermen Cooperative Society, Vemulakonda; to deposit the amounts;

and also to implement the order dated 01.04.2019 passed by this Court in W.P.No.6798 of 2019 along with G.O.Ms.No.74 dated 21.10.2011.

The material on record would show that the disputes inter se between the members of the 4th respondent-Fishermen Cooperative Society are brought before this Court in one way or the other. The District Fisheries Officer as well as the authorities under the Telangana State Cooperative Societies Act, 1964 (for short 'the Act'), has limited role with respect to the fishing operations. In the present case, the petitioner, who is one of the members of the 4th respondent Society, filed representations alleging the illegal activities of the President of the Society and mala fides on the part of the District Fisheries Officer and asserted that the District Fisheries Officer was permitting the non-members of the Society to carry on fishing operations in collusion with the President of the society. Without recourse to the statutory power and the statutory duty of the

respective authorities, in a routine manner, this Court, from time to time, after considering the facts and circumstances of each case, disposed of the matters. However, it is the prime responsibility of the authorities under the Act to monitor these aspects and to solve the problems of this nature. It is unfortunate to note that day-in and day-out, such types of writ petitions are being filed by the parties. The present petition is one among such cases where complaints/representations were made with respect to the functions of the authorities as well as the President of the Society, by sending the copies to the authorities concerned.

In those circumstances, without expressing any opinion on merits of the matter, it would be appropriate to direct the respondents to consider and dispose of the representations made by the petitioner in accordance with law.

Subject to the above, the Writ Petition is closed. No order as to costs.

6. Miscellaneous Applications, if any pending in this Writ Petition, shall also stand closed.
