THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO. 9974 OF 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for respondent No.4 Association. 2.

The prayer sought in the Writ Petition is as under: " ... to issue writ, order or direction more particularly one in the nature of writ of Mandamus directing the Respondent No. 2 and 4 to strictly implement the instructions/ guidelines issued by the Respondent No.1 in its letter vide D.O.No.813/ 2012-SP-III dated 30-10-2014 and also observations and directions of the Hon'ble Delhi High Court in W.P. No. 2310 of 2012 in functioning of Sports Federation including restrictions on age and tenure of the office bearers of all National Level federations for promoting good governance and transparency in the functioning of state and district level associations by issuing suitable instructions or framing appropriate legislations." 3.

The main grievance of the petitioner is that in spite of issuing instructions in the Circular dated 30.10.2014, the respondent Nos. 2 and 4 are not complying with the same.

Learned Standing Counsel appearing for respondent No.4 brought to the notice of this Court that election to the respondent No.4 Association was conducted in the month of July, 2014 itself. Therefore, the question of complying with the procedure contemplated under the instructions issued in Circular dated 30.10.2014 does not arise. However, learned Standing Counsel, on instructions, would submit that respondent Nos. 2 and 4 would comply with the procedure contemplated under the Circular dated 30.10.2014 as and when the elections are conducted to respondent No.4 Association.

Taking into consideration the said submission, this Court is of the opinion that no further orders are required in the Writ Petition. 6.

Accordingly, the Writ Petition is closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
