THE HON'BLE SRI JUSTICE M.S.K.JAISWAL Criminal Petition No.11741 of 2016 ORDER:

The petitioner filed this Criminal Petition under Sections 482 read with Section 451 Cr.P.C. praying to pass orders directing the S.H.O., Rajamahendravaram Prohibition & Excise Station, East Godavari, to release the stocks i.e., 26 bags of black jaggery each containing 50 Kgs. worth of Rs.13,000/- seized in Cr.No.257 of 2016-17 by permitting the petitioner to furnish third party surety before the Court of VII Additional Judicial First Class Magistrate, Rajamahendravaram, East Godavari District Heard and perused the records.

Having regard to the facts and circumstances of the case, the Criminal Petition is disposed of directing the petitioner to file application before the Deputy Commissioner of Prohibition & Excise, Kakinada- 2nd Respondent herein seeking release of the stocks and on filing of such application, the 2nd Respondent herein shall dispose of the application within a period of one week from the date of filing of the application. Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions pending, if any, in the Criminal Petition shall stand closed.
