Respondent/Complainant Petition under Section 438 of Cr.P.C, praying that in the circumstances stated in the grounds filed in support of the Criminal Petition, the High Court may be pleased to grant the anticipatory bail in the event of arresting the petitioner/A I by the police in Crime No. 14412021 on the file of W.P.S Saroornagar, Rachakonda Police Commissionerate.

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/Al seeking to grant anticipatory bail in the event of his arrest in Cr.No.144 of 2021 on the file of Saroornagar Women Police Station, Rachakonda District, registered for the offences punishable under Sections 498-A, 323, 406 and 506 IPC and ) under Section 4 of Dowry Prohibition Act.

Heard learned counsel for the petitioner/A1, learned Assistant Public Prosecutor appearing for the respondent-State and perused the record.

Learned counsel for the petitioner/Al would submit that since the date of marriage, there are no disputes between the petitioner and the defacto complainant and that her parents have developed hatred towards the petitioner. He further submits that the mother of the de-facto complainant has instigated to her to file a false complaint against the petitioner and his family members. He further submits that though the petitioner approached before the Lok Adalat on 22.12.2020 for mediation and counseling, the defacto complainant has not attended the counseling. He further submits that the petitioner never involved in any crime and he is a law abiding citizen tt I and ready to abide by any condition that may be imposed by this Court in I II the event of his enlargement on anticipatory bail. 4.

Learned Assistant Public Prosecutor vehemently opposed to grant anticipatory bail to the petitioner.

Having regard to the facts and circumstances and in view of the I t ( I nature of allegations leveled against the petitioner and since it is a

matrimonial dispute, and also in view of peculiar conditions of pandemic COVID-19 prevailing in the country, without delving into the merits of the matter, I am inclined to grant anticipatory bail to the petitioner/A1. 6.

The Criminal Petition is accordingly allowed and the petitioner/A1 is granted anticipatory bail subject to the following terms and conditions: (i) Th'e petitioner/A1is directed to surrender before the Station House Officer, Women Police Station, Saroomagar, Rachakonda District, within a period of 15 days from the date of this order and on such surrender, the said Station House Officer shall release the petitioner/A1 on bail on his executing a personal bond to the tune of Rs.25,0001 (Rupees twenty five thousand only) with two sureties for the like sum each to his satisfaction. (ii) On such release, the petitioner/Al shall appear before the lnvestigating Officer on every Saturday between 10.00 AtM and 2.00 PM till completion of investigation and filing of the charge sheet.

(iii) The petitioner/Al shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.
