THE HON'BLE DR. JUSTICE SHAMEEM AKTHER TRANSFER CRIMINAL PETITION No.63 OF 2018 ORDER:

This Criminal Petition is filed by the petitioners to withdraw the D.V.C.No.20 of 2017 on the file of the XV Metropolitan Magistrate, Cyberabad, Ranga Reddy District and to transfer the same to the Family court in Twin Cities.

Heard the learned counsel for the petitioners, learned Assistant Public Prosecutor representing the 3rd respondent-State and perused the record.

Learned counsel for the petitioners would submit that relatives of the respondent-wife are working in the said Court. Further the parents of the petitioners are old aged and they are not in a position to attend the Court. They are apprehending that they may not get appropriate justice in DVC case.

There is no compulsion for the petitioners to attend the Court on each and every date of hearing. Their Advocate on record would take care of those things. Even assuming for a while that the relatives of the wife are working in XV Metropolitan Magistrate, Cyberabad, Ranga Reddy District, they have no role to play in the process of administration of justice.

The apprehension of the petitioners cannot be a ground to allow this criminal petition. The respondent/wife has to make out a case to grant relief in her favour. There are no justifiable grounds to allow the petition.

In the result, the Transfer Criminal Petition is dismissed.

The Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
