HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 46243 of 2016 Order:

This Writ Petition was filed challenging the action of the fourth respondent in registering FIR No.163 of 2016 on the complaint of the first respondent for the offences punishable under Section 506 IPC read with Sections 3(1)(r)(s) and 3 (ii)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

This Court, by order dated 05.01.2017, directed the respondent Police to complete the investigation without arresting the petitioner and the said order has been in operation till today. This Court carefully perused the complaint and finds that registration of Crime is proper in the facts and circumstances of the case, but the allegations with regard to application of the provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, require further probe.

In the circumstances, this Writ Petition is disposed of directing the fourth respondent to complete the investigation without arresting the petitioner. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
