HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.8523 of 2019 ORDER:

The grievance of the petitioner is that the revenue authorities are not effecting mutation in her favour in relation to the land admeasuring Acs.3.04 guntas in Survey No.644 of Anwar Bagh, Uppal Kalan, Hyderabad, despite her many representations. Reference is made to the representations dated 03.11.2014, 20.7.2015, 22.6.2016, 17.8.2017 and 16.7.2018 in this regard. However, it may be noted that the petitioner never submitted an application in Form VIA under the Telangana Rights in Land and Pattadar Pass Books Act, 1971 (for brevity 'the Act of 1971'), seeking mutation.

In terms of Section 4 of the Act of 1971 read with Rule 18 of the Telangana Rights in Land and Pattadar Pass Books Rules, 1989, a person seeking mutation necessarily has to submit an application in Form VIA along with the requisite fee. Without abiding by the prescribed procedure, it is not open to the petitioner to complain of inaction on the part of the revenue authorities. The Writ Petition is accordingly disposed of permitting the petitioner to make a proper application in Form VIA along with the requisite fee seeking mutation in her favour in relation to the subject land. In the event such an application is made, the Tahsildar, Uppal, Ranga Reddy District, shall consider the same and take appropriate action thereon in accordance with law expeditiously and in any
