HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 26219 of 2017 ORDER:

Petitioner states that, by proceedings in R.Dis.No.D2/2514/2014, dated 03.09.2016, the Revenue Divisional Officer, Ananthapur, recorded a finding that respondent No.7 had no right over the land in Sy.No.245 admeasuring Ac.3.70 guntas of Thalupur Village, Atmakur Mandal. She states that, I.A.No.572 of 2014 in O.S.No.190 of 2014 was filed before the Principal Junior Civil Judge, Anantapur, wherein respondent No.7 was injuncted from interfering with the possession and enjoyment of the petitioner over the subject property till the disposal of the suit. Petitioner's grievance is that, despite letter dated 06.10.2016 by the Tahsildar, Atmakur to the Station House Officer, Atmakur, seeking to give her necessary protection to enjoy the subject property, no action has been taken against respondent No.7. Hence the writ petition. Heard the learned counsel for the petitioner. Learned Government Pleader for Home(AP), on instructions, submits that the matter is in civil nature, and a FIR has been registered against respondent No.7 and necessary steps would be taken.

Having considered the submissions of the counsel, and in as much as FIR has since been registered,

respondent No.6 shall complete investigation, and take necessary action, within a period of six weeks from the date of receipt of a copy of this order. In as much as the petitioner has been protected by injunction order, which he asserts to have become final, it shall be open for him to approach Civil Court for enforcement of the injunction order.

The Writ Petition is, accordingly, disposed of. Miscellaneous Petition, if any, shall stand closed. However, in the circumstances, without costs.
