HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION Nos.13663, 11433 & 13282 OF 2011 COMMON ORDER Since the subject matter of these writ petitions is one and same, they are heard together and disposed of by this common order.

These writ petitions are filed for a writ of certiorari calling for the records pertaining to the Award dated 04.02.2011 passed in O.A.Nos.2624, 2620 and 2630 of 2010 respectively, by the A.P.Endowments Tribunal, Hyderabad and quash the same and for a consequential direction to the respondents not to interfere with the possession and enjoyment of the petitioners' subject property. In these writ petitions, it is stated that the petitioners have no other alternative remedy. The 3rd respondent has filed counter stating that the petitioner has an alternative remedy under Section 84(2) of Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1987 (for short 'the Act'). A perusal of the writ affidavit does not disclose that the impugned order is passed without jurisdiction and in violation of principles of natural justice. But as per Section 84(2) of the Act, the petitioner has an alternative remedy.

Section 84(2) of the Act reads as follows:

"Nothing in sub-section (1) shall prevent any person aggrieved by an of the Endowments Tribunal under sub-section (4) of Section 83 from preferring an appeal before the High Court to establish that the Charitable or religious Institution or Endowment has no title to the land, building or space."

In view of the above facts and circumstances, I do not see any reason to entertain these writ petitions, as the petitioners have an alterative remedy under Section 84(2) of the Act. Accordingly, these writ petitions are dismissed. However, it is open for the petitioners to avail the alternative remedy available to them under law. There shall be no order as to costs. As a sequel, miscellaneous petitions pending if any, shall stand closed.
