THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION No.3464 OF 2017 ORDER:

This revision is filed, under Article 227 of the Constitution of India, challenging the order dated 03.07.2017 in I.A.No.491 of 2017 in O.S.No.1639 of 2016 on the file of XX Junior Civil Judge, City Civil Court, Hyderabad dismissing the application filed under Order XVI Rule 6 and Order XVIII Rule 16 of CPC read with Section 151 of CPC to summon the Assistant City Planner, Town Planning Section Circle No.8, Central Zone, Greater Hyderabad Municipal Corporation, Abids, Hyderabad.

After hearing the matter for sometime, both the counsel gave consent for summoning the witness stated above, but learned counsel for respondent requested to fix some time. Considering the request, without going into the merits of the matter, I deem it appropriate to allow the petition directing the trial Court to issue summons to the Assistant City Planner, Town Planning Section Circle No.8, Central Zone, Greater Hyderabad Municipal Corporation, Abids, Hyderabad within twenty days from the date of receipt of a copy of this order and the trial Court shall also permit the petitioner to take out handover summons and serve on the witness within specified time.

With the above observation, the Civil Revision Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this petition shall stand closed.
