This criminal petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioners/A.3 to A-5 seeking their enlargement on bail in connection with FIR No.23 of 2026 of Nizamabad Town-III Police Station. The offences alleged against the petitioners are under Sections 310, 204 and 137 (2) r/w. 3(5) of BNS.

The case of the prosecution is that on 23.01.2026 the defacto complainant lodged a report before Police, wherein it is stated that he is running a Gold and silver shop in Gandhi Gunj, Nizamabad, under the name of 'Sri Venkateshwara Gold and Silver Merchant' and two persons are working with him for the past 10 years. He gave instructions to Mr.Gangadhar to collect Rs.19,92,000/- and deposit the same in Bank. He went to Bank and as it was closed again he was returned to shop with money bag. While he was walking with cash bag accused persons introduced themselves as Police, threatened him, forcibly snatched the bag from his hand and forcefully made him to sit in car and near Basara they give him Rs.1,000/- and dropped him there. Complainant requested the police for taking necessary action, basing on the same, Police registered the case against the accused for the above offences.

Heard Sri Alluri Divakar Reddy, learned counsel appearing on behalf of the petitioners as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State.

The contention of learned counsel for the petitioners is that petitioners are falsely implicated in this case and they are

- 3 - no way connected with this offence. The petitioners are innocent of the said allegations and there is no such specific allegation against the petitioners. The petitioners are in jail from 28.01.2026 and 31.01.2026 and material part of investigation is already completed including completion of Test Identification parade As such, their custodial interrogation is not required anymore. The petitioners undertake to abide by any conditions that may be imposed by this Court. Hence, prayed this Court to grant regular bail to the petitioners.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the alleged offences are grievous and serious in nature and investigation is not yet completed. The petitioners are not entitled for bail and prayed to dismiss this petition.

Considering the submissions made and the material on record, petitioners herein are in jail from 28.01.2026 and 31.01.2026. As seen from the record part of the investigation is completed, LWs.1 to 10 are examined and Test Identification parade was already completed. Considering the period of incarceration of petitioners in jail, this Court deems it

- 4 - appropriate to grant regular bail to the petitioners subject to the following conditions:

i. The petitioners shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to the satisfaction of the Prl. Judicial First Class Magistrate at Nizamabad.

ii. The petitioners shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii. The petitioners shall abide by the conditions stipulated in Section 483(2) of the BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
