THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3461 OF 2015 ORDER:

This petition is filed by the petitioner under Section 482 Cr.P.C. seeking to quash the proceedings against him in CFR No.2278 of 2009 on the file of the Special Magistrate, Guntur, registered for the offences punishable under Sections 420 and 506 r/w.34 IPC. Heard and perused the material available on record. The de facto complainant filed a private complaint against the petitioner and the same was referred the same to the police. The police after investigating the matter, filed final report stating the matter is civil in nature. Thereafter, the petitioner filed a protest petition. Learned counsel for the petitioner submitted that the Court below without considering the said protest petition, dragging on the matter by adjourning the matter and the petitioner is an old aged person and therefore, direct the Court below to dispose of the same as expeditiously as possible.

Considering the above submission of the learned counsel for the petitioner, without going into the merits of the case, this Court is inclined to pass the following order:

The Special Mobile Magistrate, Guntur, is directed to dispose of the CFR No.2278 of 2009 in accordance with law, on or before 10th May, 2016.

With the above directions, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
