The allegations in the writ petition are that though the properties of the petitioners were sought to be acquired by invoking the provisions of the National Highways Act,1956, but as on today the respondents have not taken any steps in terms of Section 3G(5) of the said Act.
Considering the narrow scope of allegations, the learned Government Pleader for Land Acquisition placed on record the written instructions received from the Revenue Divisional Officer, Vizianagaram wherein it is categorically asserted that two Awards bearing Nos.36 and 41 of 2017 were passed on 29-12-2017 and 26-02-2018 respectively. Further, the Award copies were also dispatched to the petitioners through registered post vide RN Nos.995049417 and 995049425 dated 10-03-2018. At this juncture, the learned counsel for the petitioners submit that as on today, the petitioners have not received any Award copies. Taking into consideration the written instructions, nothing survives for adjudication in this writ petition. Accordingly, the writ petition is closed, leaving it open to the petitioners to work out remedies available under law. No costs.
