SMT JUSTICE T.RAJANI CRIMINAL PETITION No.2656 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused No.1, in Crime No.358 of 2017 on the file of the Station House Officer, Neredmet Police Station, Rachakonda District. The offences alleged are under Sections 406, 420, 468, 471 and 120-B R/w.34 of I.P.C.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 3.

The case of the prosecution is that the de-facto complainant gave huge amounts to the accused, on the representation of accused No.1, that he was having vast experience in the field of marketing the produces of his clients, preparation of various documents, creating joint ventures, dealing with Government and Semi Government Authorities and Suppliers and Dealers for the requirement of such authorities. Even after expiry of one year from paying the amounts, the de-facto complainant did not receive the payments from Mr. Ramesh Babu of M/s.Ionnix Aero Tech Private Limited and was shocked to know that M/s.Ionnix Aero Tech Private have not placed any order with her Firm. However, earlier bail petition filed by the petitioner seeking anticipatory bail, was dismissed by this Court by virtue of the orders in Criminal Petition No.11833 of 2017, on 07.12.2017, on the ground that investigation was still in progress. 4.

Learned Public Prosecutor now contends that Section 41-A Cr.P.C. notice was issued to the other accused and, hence, a similar direction be given to the Police for giving Section 41-A Cr.P.C. notice to this petitioner.

In view of the above submission of learned Public Prosecutor, the Investigation Officer is directed to issue Section 41-A Cr.P.C. notice to the petitioner before affecting his arrest in this Crime. 6.

Accordingly, with the above observation, the Criminal Petition is disposed of.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
