THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.8547 OF 2019 ORDER:
This writ petition is being disposed of at the admission stage with the consent of both parties.
This writ petition is filed seeking a writ of Mandamus declaring the inaction of the 2nd respondent in appointing the petitioner on compassionate grounds in any suitable post as per representations of the petitioner dated 10.11.2008 and 02.05.2017 as illegal, arbitrary, contrary to law and violation of Articles 14, 16 and 21 of the Constitution of India. Heard Sri Mohd. Ghulam Rasool, learned counsel for the petitioner, and Sri Buchi Reddy, learned Standing Counsel for the 2nd respondent. It has been contended by the petitioner that her father, who was employed with the 2nd respondent Corporation, has expired on 21.02.2008 while he was in service. Thereafter, the petitioner has submitted representations to the respondents on 10.11.2008 and 02.05.
2017 requesting the respondents to consider her case for appointment on compassionate grounds in any suitable post. The grievance of the petitioner is that the respondents are neither considering the representations submitted by her nor considering her case for appointment on compassionate grounds. Therefore, learned counsel for the petitioner contends that appropriate orders be passed in the writ petition directing the respondents to consider the case of the petitioner for appointment on compassionate grounds by duly considering the representations submitted by the petitioner.
Learned Standing Counsel appearing for the 2nd respondent had contended that the case of the petitioner would be considered and
appropriate orders will be passed on the representations submitted by the petitioner.
This Court, having considered the rival submissions made by the respective parties, is of the considered view that this writ petition can be disposed of directing the petitioner to submit a fresh representation to the respondents within a period of two weeks from the date of receipt of a copy of this order and upon such representation being submitted, the respondents shall consider the same and pass appropriate orders within a period of four weeks thereafter.
With the above observations, the writ petition is disposed of. No order as to costs.
