The petitioner, who is A4, filed the present application under Sections 437 and 439 of the Code of the Criminal Procedure (Cr.P.C.), seeking enlargement on bail in Crime No.24 of 2015 of Rolugunta Police Station, Visakhapatnam District, registered for the offences punishable under Sections 20(i)(b) and 25 of NDPS Act.

Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the trial Court to consider the case of the petitioner afresh. He further submits that the petitioner is HIV patient.

Having regard to the changed circumstances, more particularly, considering the fact that the petitioner is HIV patient, the petitioner shall file relevant documents to prove the same and file fresh application before the trial Court, in which event, the same shall be dealt with at the earliest.
