ORAL ORDER:

Petitioner filed this writ petition questioning the action of the respondents 2 to 5 in not conducting the survey and demarcation of mining land area under S.No.571/F2/1 to an extent of 6.621 Hectares of Kochervu village, Dhone mandal, Kurnool district as illegal.

Alleging illegal encroachment into the lease of the land granted to petitioner by respondents 7 to 12, petitioner submitted representation to the Revenue Divisional Officer and District Ciollector dated 24.10.2014. The District Collector by his letter dated 1.11.2014 directed the Assistant Director of Mines and Geology, Kurnool and Survey and Land Records, Kurnool to look into the grievance of the petitioner and take necessary action in accordance with the rules. Alleging inaction on the part of the authorities, this writ petition is filed. Heard the learned counsel for petitioner, learned Government Pleader for Revenue for respondents 1 to 4 and learned Government Pleader for Mines for respondents 5 and 6 and with their consent the writ petition is taken up for disposal at the admission stage.

When the matter is taken up, learned counsel for petitioner submitted that it would suffice if the writ petition is disposed of directing the competent authority to consider the grievance of the petitioner as referred to by the District Collector and take appropriate action expeditiously.

Having regard to the same, writ petition is disposed of directing the respondents 5 and 6 to consider the grievance of the petitioner and if there is necessity to conduct survey, notice be caused on respondents 7 to 12 and after affording reasonable opportunity of hearing to them, survey and demarcation be conducted in presence of petitioner and respondents 7 to 12 and appropriate orders as warranted by law be passed as expeditiously as possible preferably within six weeks from the date of receipt of copy of this order.
