ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for Shop No. 17 of Ramapuram village, Tadimarri Mandal, Ananthapur District. While so, the Deputy Tahsildar (Civil Supplies) along with his staff inspected the fair price shop of the petitioner on 5.6.2015 and noticed some irregularities. Pursuant to the same, a report was submitted to the third respondent on 6.6.2015 and on the same day a show cause notice was issued to the petitioner. Being not satisfied with the explanation submitted by the petitioner on 13.6.2015, the third respondent

passed the impugned order dated 18.6.2015 suspending the authorization of the petitioner pending enquiry. Challenging the same, the present Writ petition is filed.

This Court perused the charges levelled against the petitioner and is of the prima facie opinion that the said charges required to be enquired into. In these circumstances, this Court is not inclined to interfere with the enquiry process at this stage. As the petitioner has already submitted his explanation, the third respondent is directed to complete the enquiry and pass final order within thirty days from the date of receipt of a copy of this order by following due principles of natural justice during the enquiry process.

The Writ Petition is disposed of. As a sequel thereto, the miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed. No order as to costs. --------------------------------------------------- JUSTICE A.RAMALINGESWARA RAO Dated 14th July, 2015.
