THE HON'BLE SRI JUSTICE K.C. BHANU WRIT PETITION No.14496 of 2015 ORDER:

The relief sought for in the Writ Petition is as follows: "to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents herein in trying to take possession of the lands of an extent of 350 sq. yards of Anthenarevu Jagannaikpur, Kakinada in D.No. 44-16-12/3, Ward No. 26, Kakinada, East Godavari District without passing final order on the explanation dt.30-04-2015 submitted by the petitioner to the show cause notice dt.25-04-2015 issued by the 4th respondent herein, as illegal, arbitrary, null and void and contrary to the provisions of the A.P.Land Encroachment Act 1905 and for a consequential direction to the respondents herein to drop further proceedings" The grievance of the petitioner is that the respondents are trying to dispossess him from the subject land though he submitted an explanation to the show cause notice issued by the fourth respondent.

Since the petitioner has submitted his explanation to the show cause notice, the fourth respondent has to take appropriate decision in accordance with law. Accordingly, the Writ Petition is disposed of directing the fourth respondent to take appropriate decision in accordance with law in pursuance of the show cause notice by duly taking note of the explanation submitted by the petitioner, within a period of four weeks from the date of receipt of a copy of this order. In the meantime, no coercive steps shall be taken by the respondents. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
