THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.6988 of 2018 ORDER:

In this Writ Petition, petitioner claims that he is the owner of open plot bearing No.107A in Survey No.218 situated at Bethamcherla Village and Mandal, Kurnool District. He asserts that the third respondent - Bethamcherla Gram Panchayat is proposing to lay a drainage pipeline through his plot and thereby, the area for his house construction is getting reduced and the third respondent has not offered compensation nor taken any steps.

Heard learned counsel for the petitioner.

On the other hand, Sri G. Seshadri, learned Standing Counsel for Bethamcherla Gram Panchayat appearing for the third respondent, submits that initially, the petitioner had agreed for laying the drainage pipeline through his plot but now, he has taken a different stand. He further submits that in the event of the petitioners' land getting affected, the respondent Gram Panchayat would initiate necessary proceedings in accordance with law. He also submits that without following due process, the third

CKR, J W.P.No.6988 of 2018 respondent would not interfere or lay a pipeline in the petitioner's land.

Placing on record the aforesaid submissions of the learned Standing Counsel, the Writ Petition is disposed of. Miscellaneous Petitions, if any pending shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J 9th MARCH, 2018.
