Heard learned counsel for the petitioner/accused, learned Assistant Public Prosecutor for 1st respondent-State and perused the record.

This petition is filed under Section 482 Cr.P.C. to quash the proceedings in Crime No.641 of 2017, Jubilee Hills Police Station, Hyderabad, registered for the offences under Sections 3(1)(ZC) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and 406, 420 and 506 IPC.

Learned counsel for the petitioner would submit that there is a partnership business between the father of the de facto complainant and mother of the petitioner/accused. They have deposited the title deeds and obtained bank loan and they are together doing the business. It is absolutely false that the father of the de facto complainant is not allowed to participate in the business. It is alleged that the partnership business is running in loss. No alleged incident took place as mentioned in the FIR dated 03.10.2017. The petitioner has not abused the de facto complainant. It is further alleged that the dispute between the parties is civil in nature. The truth or otherwise of the allegations do require investigation.

Under these circumstances, there are no grounds to quash the proceedings in this crime against the petitioner/accused, but a direction can be given to the Station House Officer. The Station House Officer concerned shall complete the investigation in this case and file final report without arresting the petitioner/accused.

With the above direction, the Criminal Petition is disposed of. The Miscellaneous Petitions, if any, pending shall stand closed.
