1. Inspite of granting several adjournments, on O5.O9.2O23 learned counsel for the appellant report not ready and the matter is posted to today under the caption for dismissal. Inspite of the appeal is listed under the caption for dismissal; today also seeks time to advance the arguments.

The suit is filed by the appellant challenging the assessment notice dated 09.01.1996 for consumption of electricity charges and the sarne was dismissed. No stay is granted by this Court; perhaps the recovery must have been done.

Accordingly, the Appeal Suit is dismissed for nonprosecution. No costs. Miscellaneous petitions, pending if any, shall stand closed.
