HON'BLE SRI JUSTICE SURESH KUMAR KAIT Writ Petition No.30495 of 2016 ORDER:
Vide the present petition petitioner seeks direction thereby directing the respondents for release of Skoda Motor Car bearing registration No.TS 09W TR 3672.
The present petition was taken up before noon. The learned Standing Counsel for the Respondent-Bank sought adjournment on the ground that he had to take instructions from his client.
It is admitted fact that the petitioner had to pay instalments from November, 2015 for an amount of Rs.15,368/- per month. As per annexure- P6, the petitioner has paid nine instalments till August, 2016. More over, as sated by the learned standing counsel for the respondent-bank, the petitioner has not got registration of vehicle and still he is continuing with temporary registration.
As on date, up to September, 2016, total 11 instalments are there. The petitioner has paid nine instalments and accordingly, he will clear the instalments up to September, 2016 and on clearance of the same, the respondent-bank is directed to release the vehicle in favour of the petitioner. The petitioner is further directed to get the vehicle registered and for the said purpose, if any cooperation from the bank is required, the bank is also directed to cooperate and get the vehicle registered.
I hereby made clear that if the petitioner fails to pay instalments up to September, 2016 within two days and get the vehicle registered within a week, the respondent-bank is at liberty to seize the vehicle from the petitioner and any action can be taken as per law. The petitioner shall furnish his address of stay to the respondent-bank and also furnish the address as and when he changes the same. In view of the above direction, the Writ Petition is disposed of. No order as to costs.
Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
