HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.33147 OF 2017 O R D E R :

This writ petition is filed challenging the proceedings dated 11.09.2017 issued by the 2nd respondent whereby the services of the petitioner were terminated on the ground that the petitioner proceeded on Medical Leave from 01.08.2017 to 06.07.2017 without prior permission of the 2nd respondentMedical Officer. Learned counsel for the petitioner submits that admittedly the petitioner applied for leave and that the 2nd respondent is the competent authority to sanction leave but, instead of sanctioning the leave he forwarded the same to the 3rd respondent on whose direction the impugned order is passed. He further submits that the petitioner has rendered 9 years of unblemished service.

Heard learned Government Pleader for Services. It is to be seen that admittedly the petitioner applied medical leave from 01.08.2017 to 06.09.2017, but the 2nd respondent without sanctioning the leave of the petitioner passed impugned orders terminating the petitioner from service, without issuing any notice to the petitioner. In view of the same, the impugned order is set aside. However, this

order will not preclude the competent authority from passing orders after issuing notice to the petitioner. Writ petition is allowed to the extent indicated above. No order as to costs.

As a sequel to disposal of the writ petition, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
