THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.2669 OF 2018 ORDER:
Heard learned counsel for the petitioners/A.1 and A.2, learned Assistant Public Prosecutor for 1st respondent-State and perused the record.
This petition is filed under Section 482 Cr.P.C. to quash the proceedings in C.C.No.490 of 2017 on the file of the XXV Metropolitan Magistrate, Cyberabad, Kukatpally, Ranga Reddy District, registered for the offences under Sections 447 and 427 IPC.
Learned counsel for the petitioners/A.1 and A.2 would submit that the petitioners are owners of the land in Survey No.13 situated at Khanamet Village. The de facto complainant and his family members have no right to interfere with the said land. The criminal case is foisted against them. There is a survey report to show that the disputed land belongs to the petitioners/accused and ultimately prayed to allow the petition.
Learned Assistant Public Prosecutor opposed the relief sought by the petitioners.
As per the record placed before this Court, the de facto complainant and others purchased one acre of land in Sy.No.12, Khanamet Village vide registered document Nos.7912/1996 and 7913/1996 dated 24.09.1996 from Bongu Hanmanth Rao and B.Venkata Rao.
Having argued for a considerable time, now at this stage learned counsel for the petitioners intends to withdraw the petition.
Under these circumstances, the Criminal Petition is dismissed as withdrawn.
The Miscellaneous Petitions, if any, pending shall stand closed.
