HONOURABLE SRI JUSTICE SANJAY KUMAR CRIMINAL PETITION No.2298 of 2019 ORDER:

The petitioner is accused No.5 in Crime No.51 of 2019 on the file of Yadagirigutta Police Station, Rachakonda District, registered under Sections 386, 120B and 506 I.P.C. By way of this petition filed under Section 438 Cr.P.C., the petitioner/accused No.5 seeks grant of anticipatory bail.

The case of the prosecution is that the petitioner/accused No.5 is one of the members of the dreaded gang of Nayeem, the deceased gangster, and the complainant stated that he along with others came and threatened him of dire consequences if he did not give into their demands.

Learned Assistant Public Prosecutor, State of Telangana, would inform this Court that the investigation is still ongoing. As one of the charges levelled is under Section 120 B IPC, the role of the petitioner/accused No.5, if any, in the gang activities would have to be established. Granting him pre-arrest bail would hamper the investigation as there is every possibility of his tampering with the evidence. This Court is therefore not inclined to grant any relief to the petitioner/accused No.5 at this stage.
