THE HON'BLE THE CHIEF JUSTICE SRI RAGHVENDRA SINGH CHAUHAN AND THE HON'BLE SRI JUSTICE B. VIJAYSEN REDDY WRIT PETITION Nos.5672, 5679, 5748, 6109, 6239, 6250, 6305, 6307, 6320, 6323, 7854, 9283, 9518, 8244, 9625, 9662 and 9701 OF 2020 COMMON ORDER: (Per Hon'ble the Chief Justice Sri Raghvendra Singh Chauhan) All these writ petitions have been filed challenging the closure notices issued by the Greater Hyderabad Municipal Corporation (GHMC) under Sections 521 and 622 of the Greater Hyderabad Municipal Corporation Act, 1955.

The learned Advocate General, Mr. B. S. Prasad, informs this Court that GHMC has taken a decision to withdraw all these notices, and to issue fresh notices under proper provisions of law. Since the impugned notices are being withdrawn by the GHMC, these writ petitions have become infructuous. Therefore, these writ petitions are dismissed as infructuous.

However, liberty is granted to GHMC to issue notices, if necessary, to the petitioner, but strictly in accordance with law. Although the GHMC is directed to unseal the premises, where the premises have been sealed, the petitioners shall not be permitted to carry out their business, until and unless the GHMC is satisfied that the business carried out by the petitioners is not in violation of the laws. It is, for the GHMC to decide if the business is in violation of the laws, or not. Miscellaneous petitions, pending if any, shall stand closed. There shall be no order as to costs.
