CVNR, J & CKR, J WP.No.32438 of 2017 Dt: 01.11.2017 Order: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Petition is filed for a Mandamus to set aside Order, dated 28-04-2017, in ITA.No.92/Hyd/2018 on the file of the Income Tax Appellate Tribunal, Hyderabad 'A' Bench, Hyderabad.

At the hearing, Mr.K.Mohan Rami Reddy, learned Counsel for the petitioner, submitted that after filing of the Writ Petition, a statutory appeal viz., ITTA.No.684 of 2017 was filed by the petitioner questioning the order impugned in this Writ Petition and that therefore, this Writ Petition has become infructuous. Recording the aforesaid submission of the learned Counsel for the petitioner, this Writ Petition is dismissed as infructuous without prejudice to the right of the petitioner to pursue ITTA.No.684 of 2017.

As a sequel to dismissal of the Writ Petition, WPMP.No.40244 of 2017, filed by the petitioner for interim relief, is dismissed of as infructuous.
