HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 21192 of 2015 DATED 10th July, 2015 BETWEEN Smt. K.Bhagyalaxmi

...Petitioner

And The State of Telangana, Rep. by its Commissioner of Civil Supplies Department and Ex-Officio Secretary, Hyderabad and ors.

....Respondents.

HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 21192 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as Fair Price Shop Dealer for Shop No. 2 of Pasumamula Village, Hayatnagar Mandal, Ranga Reddy District. While so on 13.04.2015 the Mandal Revenue Officer along with his staff inspected the fair price shop of the petitioner and found some variations. Pursuant to the same 6-A proceedings are initiated and the same are pending. Thereafter a show cause notice was issued to the petitioner on 16.4.2015, to which the petitioner submitted his

detailed explanation on 25.4.2015.

Thereafter, the third respondent by order dated 16.4.2015 suspended the authorization of the petitioner. Challenging the same the present Writ Petition is filed.

This Court carefully perused the allegations levelled against the petitioner and is prima facie of the opinion that the said allegations require to be enquired into. Further 6-A proceedings initiated against the petitioner are pending. In those circumstances this Court is not inclined to interfere with the enquiry process at this stage. As the petitioner has already submitted her explanation on 25.4.2015, the third respondent is directed to complete the enquiry within a period of thirty days from the date of receipt of a copy of this order by giving due opportunity and observing principles of natural justice during the enquiry process.

The Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
