HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5040 OF 2015 ORDER:

This Criminal Petition is filed by the petitioners/accused under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.32 of 2015 of Mummidavaram Police Station, East Godavari District for the offences punishable under Sections 498-A, 312 and 511 I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act. Heard the learned counsel for the petitioners and the learned Public Prosecutor (Andhra Pradesh) for the State before notice to respondent No.2/de facto complainant and before admission.

On perusal of the material on record, as it falls short to admit the application under Section 482 Cr.P.C, however the factual matrix admit the petitioners entitlement to regular bail, this application is disposed of giving liberty to them to approach the learned Magistrate concerned by surrender and move for regular bail, in such an event after hearing Additional Public Prosecutor concerned, the learned Magistrate shall grant bail on the same day with necessary conditions. Needless to say at the post bail stage the presence of the petitioners can be dispensed with pending investigation.
