THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.7012 of 2018 ORDER:

This Writ Petition is filed challenging the action of the 3rd respondent in issuing notice on 21.02.2018 seeking to attach house property bearing No.13-3-396/A/1/1, situated at Durga Nagar, Jiyaguda, Hyderabad, pursuant to the order, dated 26.10.2017, in Crl.M.P.No.1943 of 2016 in Crl.M.P.No.1697 of 2015 in M.C.No.189 of 2015 passed by the learned IX Additional Metropolitan Sessions Judge, Nampally, Hyderabad. 2.

The said order was passed due to non-payment of an amount of Rs.1,04,000/- towards arrears of maintenance by one D.Nanda Kishore, who is none other than the brother of the petitioner herein. Now, it is the case of the petitioner that the door number of the house was wrongly mentioned and the said Nanda Kishore has nothing to do with the said house, which is in possession of the petitioner. If that is so, it is open to the petitioner to take appropriate steps before the Judge, Family Court-cum-IX Additional Metropolitan Sessions Judge, Nampally, Hyderabad, but no relief can be granted in these proceedings, which are consequential proceedings to the warrant of attachment. 3.

The Writ Petition is, accordingly, dismissed. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
