HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.276 of 2016 ORDER:

Heard both sides. While upholding the impugned order dated 31.12.2015, it is made clear that what is the observation in the eviction decree of the trial Court holding as a tenant liable to be evicted since impugned in the appeal, it is required to be decided in the appeal uninfluenced thereby, but on merits.

Further whatever the defendant/appellant deposited by maintaining RCC.No.65 of 2012 under Section 8 of the Andhra Pradesh Buildings (Lease, Rent & Eviction) Control Act, 1960 (for short 'the Act') of Rs.2,900/- per month, by virtue of this order he can withdraw therefrom and comply the order of the appellate Court pursuant thereto by depositing the balance if any, representing Rs.2,900/- per month from October 2011, preferably within one month from the date of receipt of a copy of this order. Accordingly, the revision is disposed of.

Consequently, miscellaneous petitions, if any shall stand closed. No costs.
