Admittedly, against the order of the Revenue Divisional Officer, Tirupati/ 3rd respondent in D.Dis.H/ 2376/ 2011 dated 25.06.2011, the appeal filed by petitioner before the 2nd respondent in case No.Roc.D4/ 210/ 2014 dated 04.07.2014 is pending. The learned counsel submit that the appeal can be directed to be disposed of by the 2nd respondent and continue to maintain the order dated 15.05.2014.
This Court through order dated 15.05.2014 directed the respondents not to take steps for dispossession of petitioner from the subject land. The 2nd respondent through proceedings dated Roc.D4/ 210/ 2014 dated 04.07.2014 directed implementation of the order dated 15.05.2014.
Having regard to the above circumstances, this Court is of the view that to give quietus to the litigation at the earliest, the writ petition can be ordered by maintaining the interim order dated 15.05.2014 till the disposal of the appeal.
The 2nd respondent is directed to consider and dispose of the appeal filed by petitioner within two months from the date of receipt of copy of this order. The petitioner is given liberty to file memo and seek a date for early hearing of the appeal. The interim order dated 15.05.2014 to continue till the disposal of the appeal. The writ petition is, accordingly, ordered. There shall be no order as to costs.
Consequently, miscellaneous petitions, if any pending, stand closed.
